Passenger transportation by Mokulele Flight Service. (hereafter “Carrier’) is subject to the following terms and conditions. By purchasing ticket or accepting transportation, the passenger agrees to be bound to set forth terms and conditions in addition to any term and conditions printed on but not limited to any ticket, ticket-less travel authorization, www.mokulele.com website, or published Carrier’s schedules.
Notice
If the passenger’s journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw convention may be applicable and the Convention governs and in most cases limits the liability of carriers for death or personal injury and in respect of loss or damage to baggage. MOKULELE AIRLINES ASSUMES NO RESPONSIBLITY FOR ANY LOST OR STOLEN COUPONS OR COUPON BOOKS.
1. Definitions
As used in this contract ticket means “passenger ticket and baggage check,” issued by the Carrier or its Agents, which provides for the carriage of passenger and his or her baggage. Carriage is equivalent to transportation. Warsaw Convention refers to the Convention for the Unification of certain Rules Relating to International Carriage by Air signed at Warsaw, October 12, 1929, or the Convention as amended by The Hague, September 28th, 1955, whichever may be applicable.
2. Application of Conditions
The terms and conditions contained in this Contract of Carriage shall govern all services provided by Carrier and the application of all fares, rates, charges published by the Carrier for published routes and services. Carrier may amend these Conditions of Carriage at anytime. Passenger will be governed by the terms and conditions in effect as of the date carriage commences.
3. Reservations
Confirmed reservations are not required when using Likiki Lele coupon booklet as a form of payment; however reservations are recommended. Reservations may be obtained by calling Mokulele Airlines Reservations at 808.426.7070 or 866.260.7070; or Travel Agents may book via their CRS on any MW flight in “L” class of service. Seat assignments in Main Cabin are granted at time of reservation, but are not guaranteed. Coupon must be surrendered at least 30 minutes prior to departure or reservation may be cancelled. The bearer of this Likiki Lele coupon booklet must present coupon at any MW ticket counter prior to departure and exchange a Flight Coupon for a valid reservation. Flight Coupons may not be returned once exchanged into a confirmed reservation on Mokulele Airlines. One take off & one landing = one segment. One coupon per segment is required; flights that operate with a stop or connection require ONE COUPON per take off & landing.
4. Transfer of Terms and Conditions
An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its agent. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants, and representatives.
5. Tickets
All tickets are valid for carriage for six(6) months from the date of issue or expiration date on coupon. Non-refundable tickets are non-transferable and subject to per segment change fees plus applicable fare differences.
Exceptions: In the event of a cancellation or delay on the part of carrier or weather, changes to itinerary will not incur penalty. No refunds are permitted on any unused, lost, or stolen Likiki Lele coupon booklet. In the event of an irregular operation, customers who have surrendered Flight Coupons shall be given the opportunity to rebook at a future date & time at no additional penalty or additional collection of fees.
6. Carriage
Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetable or elsewhere are not guaranteed and form no part of this contract; Carriers may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections. Passenger shall comply with all governmental travel requirements, present valid positive photo identification issued by the government. Passenger shall arrive at the airport by time fixed by carrier. Any passenger not checked in at least 30 minutes prior to departure will automatically forfeit their reservation. Mokulele Airlines flights 100-999 are operated by Shuttle America, Inc. on behalf of Mokulele Airlines and those flights operate under the Mokulele Flight Service Contract of Carriage.
7. Baggage
All baggage must be checked to the allowance of ONE checked bag, 50 pounds each and bags must be within normal size and shape. Excess weight will be charged fee and will be subject to standby status. Each piece of baggage shall be no heavier than 70 lbs, no longer than 5 ft. — Firearms, plants, or hazardous materials will NOT be accepted. Checked Baggage will be delivered to bearer of baggage check, In case of damage to baggage, claim must be submitted immediately, in person, prior to airport departure. In case of delay, complaint must be made within 24 hrs of delivery of baggage. Liability for loss, delay or damage to checked baggage is limited unless a higher value is declared in advance and additional charges are paid: (1) for travel wholly between U.S. points, to $3,300 per passenger (unless a higher amount is established by the Department of Transportation); (2) for most international travel (including domestic portions of international journeys), to $9.07 per pound ($20 per kilo) for checked baggage and $400 per passenger for unchecked baggage in the custody / control of the carrier. For international travel, the weight of each of baggage will establish the carrier liability limit; maximum liability, unless excess weight is noted and additional charges paid, is limited to carrier fee weight allowance. Excess valuation may not be declared on certain types of articles. Mokulele Flight Service assumes no liability for certain valuable, fragile, or perishable articles including but not limited to Securities, Negotiable items, Cameras (Still or Video), Computers, Electronics, Jewelry, Alcohol, Cash or Bonds. Further information may be obtained from a Mokulele Representative.
8. Refusal to Transport
Mokulele Airlines or any of its assigned agents may, at any time, refuse transport to any customer at any time for any reason without cause.
9. Authority
No agent, servant or representative of carrier has the authority to alter, modify or waive any provision of this contract unless authorized by a corporate officer of carrier
